Have your say on a Human Rights Act for Queensland

We will be making a submission on the effectiveness of current laws and mechanisms for protecting human rights in Queensland and possible improvements, specifically for people with mental illness.

We raised some issues on the draft Mental Health Bill in 2015, including:

  • Reference to the United Nations Convention on the Rights of Persons with Disabilities (UN CRPD) and the expectation that patients can raise concerns with an officer outside the system, consistent with the United Nations Optional Protocols on the Convention on Torture.
  • The Optional Protocols require jurisdictions to provide external oversight of all places where people are deprived of their liberty, such as prisons and psychiatric hospitals.
